Disputes often arise between parents and school districts concerning the accommodation of children having “special needs”. Our education law attorneys have extensive experience in representing children with physical and/or learning disabilities and their families in the implementation of special education requirements under IDEA and Section 504 of the Rehabilitation Act, as well as the ADA.

Our attorneys consult with physicians and learning specialists in order to determine what type of program in the school district will best serve the child’s needs or whether placement in a private, specialized school is in the best interests of the child. Where disputes arise between parents and school districts concerning the accommodation of students, we commence appropriate proceedings. We encourage the use of alternate dispute resolution methods, including special education mediation and arbitration, where it is in the best interests of our clients. However, where it is advantageous to do so, we zealously institute and pursue litigation both administratively before the Commissioner of Education and in State Court.

In addition to special education accommodation issues, our education lawyers are experienced in representing children and their families in student discipline issues, including suspensions and expulsion hearings.

Our firm also has represented numerous teachers in disputes with their employers over discipline, salary, and tenure issues.
