Healthcare Law

Our firm’s healthcare attorneys have extensive experience in advising individual physicians and their corporate entities with respect to general commercial and litigation issues such as:

  • Business structuring
  • Mergers and acquisitions
  • Contract negotiations with hospitals and other physicians
  • Institutional financing
  • Managed care and other third-party payor contracting and dispute resolution
  • Real estate purchases and lease negotiations
  • Electronic medical records software licensing and implementation
  • Partnership breakups and restrictive covenant litigation

We also have counseled our clients with respect to medical staff and board management issues, payment reimbursement issues and licensure issues. Our representation of a non-profit hospital-based mental health facility included drafting appropriate amendments to the facility’s hospital bylaws, developing a complete set of medical staff bylaws, and successfully guided the facility through JCAHO accreditation. Similarly, we have successfully led a free-standing imaging center through the ambulatory care licensure procedure.

Our healthcare attorneys have guided physicians through disciplinary proceedings before the NJ Board of Medical Examiners and before disciplinary boards of various other states.

The regulatory issues facing healthcare providers and clearinghouses today are complex and constantly evolving. Our firm’s healthcare attorneys have developed an extensive understanding of both federal and state regulatory issues, including HIPAA, Stark and anti-kickback laws. We have assisted our individual physician, physician group and healthcare clearinghouse clients in understanding and meeting applicable rules and regulations.
